These terms and conditions ("Agreement") govern your use of the file converter web application ("the Service") provided by QuixVert ("the Company"). By using the Service, you agree to be bound by this Agreement. If you do not agree with these terms and conditions, you must refrain from using the Service.

We reserve the right to rectify or modify these Terms of Use at any given time. In the event of any changes, we will prominently indicate them at the top of this page along with the date of modification.

Acceptance of Terms

By accessing or using the Service, you represent and warrant that you have read, understood, and agree to be bound by this Agreement. If you are using the Service on behalf of an organization, you further represent and warrant that you have the necessary authority to bind that organization to this Agreement.

Service Description

The Service provides a file conversion functionality, allowing users to convert various file types. The Company will make reasonable efforts to ensure the accuracy and reliability of the Service, but cannot guarantee that the converted files will be error-free or meet specific requirements.

User Obligations

a. Eligibility: You must be at least 18 years old or have the legal capacity to enter into a binding agreement to use the Service. By using the Service, you warrant that you meet these requirements.

b. Account Creation: You may be required to create an account to access certain features of the Service. You are responsible for maintaining the confidentiality of your account information and agree to accept responsibility for all activities that occur under your account.

c. Compliance with Laws: You agree to use the Service in compliance with all applicable laws, regulations, and third-party rights.

Intellectual Property

a. Ownership: The Service, including its design, graphics, text, and underlying software, is the intellectual property of the Company and is protected by copyright and other intellectual property laws. You acknowledge that you have no ownership rights in the Service.

b. User Content: By uploading files to the Service, you retain ownership of your content. However, you grant the Company a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute the content for the purpose of providing the Service.

Limitation of Liability

a. No Warranty: The Service is provided on an "as is" and "as available" basis. The Company does not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. Your use of the Service is at your own risk.

b. Limitation of Liability: To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the use or inability to use the Service.

Termination

The Company reserves the right to suspend, restrict, or terminate your access to the Service at any time and for any reason without prior notice or liability. Upon termination, your right to use the Service will immediately cease.

Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of South Africa.

Refund Processing

Once we receive your refund request, we will review it thoroughly. If your claim is approved, we will initiate the refund process. Please note that the refund will be issued using the same payment method you used for the original purchase.

Refund Limitations

Please be aware that our refund policy has certain limitations and exceptions, which include but are not limited to the following:

a. Refunds are not guaranteed and will be evaluated on a case-by-case basis.

b. Refunds will not be granted for reasons unrelated to the performance or functionality of our service.

c. No refunds will be provided for subscription periods that have already passed.
